The Sunset Garden Ballroom

The Sunset Garden Ballroom is a multifunctional, fully air-conditioned function room. The room has a rustic atmosphere with a high ceiling build up from wooden beams.

The side facing the sea is made from large French doors, which gives a beautiful view on the gardens and the ocean.

The Ballroom is perfectly suitable to hold different kind of functions like: private dinners, receptions, weddings, communions, birthday parties, seminars or meetings.

Function including dance floor: 160 persons
Function without dance floor: 180 persons
Seminar: 80 persons

The Sunset Garden Ballroom is open seven days a week, each day from 8:00 am till 01:00 am.

The Sunset Beach Bistro

The Sunset Beach Bistro is situated right at the beach at about 30 feet from the Caribbean Sea and has a gorgeous panorama.
The inside of the restaurant is rustic and open-aired; the French doors all around the restaurant make it easy for anyone to enjoy the spectacular ocean view. The patio in front of the restaurant has a large wooden shade roof, which gives the restaurant a romantic atmosphere.

The restaurant is open daily from 7:30 am till 10:30 PM for breakfast, lunch and dinner.

The Sunset Beach Bistro is a popular gathering spot for local business people, many business receptions have been held at the Bistro. The Bistro is very suitable for dinners, parties, weddings and receptions in a real Caribbean Atmosphere.

The restaurant has a seating capacity for 160 guests, 80 inside the restaurant and 80 outside the restaurant. For larger parties we use part of our beach, which has a capacity of 140 guests. In total the Sunset Beach Bistro has a seating capacity for 300 guests and for other type of functions, like for e.g. family days, we have a capacity up to 1000 guests.

Rental and Payment Conditions

Reservation Priority
The Sunset Garden Ballroom is on a first come first serve basis.
The client/organizer, which has paid a, required, non-refundable deposit of Afl.500.00 and has signed the contract, has the priority on any other reservation.
Fifty (50%) of the total estimated bill must be paid at least fourteen (14) days before the event. Final payment is due three (3) days prior the event. The deposit ad. Afl.500.00 will be deducted form the final payment.
Failure to pay the deposit or any of the next required payments will automatically result in cancellation of this agreement.

Divi Phoenix Beach Resort Catering Service – Food & Beverage
All catering, food & beverage services must be agreed upon in advance and cannot be cancelled after 5 days before the date of the event. The Divi Phoenix Beach Resort will be entitled to liquidate damages based on the following scale:
4 days (96 hours) - 10% of estimated balance plus non-refundable deposits
3 days (72 hours) - 25% of estimated balance plus non-refundable deposits
2 days (48 hours) - 50% of estimated balance plus non-refundable deposits
1 day (24 hours) - 100% plus non-refundable deposits
Rates and food and beverage services are charged per person. The occupancy of the room may not exceed the amount shown on the signed agreement without prior, written approval. No room rent will be charged if the total of food and beverage order exceeds Afl.3000.00. Note that all food and beverage services are subject to a 15% service charge

Room setup/cleanup – deliveries and decorations
It is agreed that the Divi Phoenix will setup and cleanup the room. It is the clients/organization’s responsibility to inspect the room, in advance, to check the room is in order. In addition, extra cleanup charges will be added if extraordinary cleanup work is required due to client/organization party.
Decorations must take place on the same day of the event. However, it can be arranged to decorate, receive equipment, goods, displays or any other materials on another day. This must however be agreed upon in advance. Failure to do this may result in deliveries being refused or materials being unavailable when required. The client/organization is responsible for insuring its property for loss or damage.

Protection of Divi Phoenix Beach Resort Property
Nothing shall be nailed, screwed or otherwise permanently attached to columns, walls, viewing screens, floors or other parts of the building or the furniture.
The clients assumes full responsibility for the conduct of all persons in attendance and will be responsible for any damage done on any part of the premises or property for the duration of the time in which they are under the control of the client/organization, including guests or third parties hired by the client/organization. Divi Phoenix reserves the right to refuse service or to eject any member for disruptive behavior. For security reasons, Divi Phoenix reserves the right to inspect the room at any time. All guests are subject to identification/age verification.

Acceptance, Deposit and settlement of account
The undersigned is the client or an authorized representative to sign on behalf of the organization listed in the first page and to enter into this agreement.
Divi Phoenix will not be held responsible for Acts of God, strikes, or any other causes beyond its control. Divi Phoenix may also terminate this agreement and cancel the event without liability of any nature if the signed client/organization fails to comply with any terms of the agreement, upon 7-business days notice to the client/organization stating the reasons for cancellation. Upon signature, it is agreed upon details of the event, payment due date, and all terms and conditions of this agreement.In the event either party brings an action to enforce the terms of this agreement, Divi Resorts will be entitled to recover its attorney fees and costs

Rentals and Purchases
The client/organization agrees to pay all expenses incurred by Divi Phoenix for arrangements made on behalf of the client and/or organization. Divi Phoenix is not responsible for displeasure with any arrangements made on behalf of the client/organization with vendors and/or contractors.

Hold Harmless
The client/organization shall hold Divi Phoenix harmless for any liability for damages to any person or property in or upon the premises during the time that the premises are under the control of the client/organization or for any damages to property or persons resulting from the actions of the client. Additionally, it is understood and agreed that all property kept, stored or maintained by client/organization or its attendees is done so at the risk of the client/organization and its attendees and that Divi Phoenix has no responsibility for such property.
Divi Phoenix shall not be responsible for any loss or damage to persons or property, which might be the result of lightning, windstorms, or other acts of God.

Authority
Any person signing an agreement in the name of a cooperation or organization represents that he/she is authorized to sign the contract on their behalf. Divi Phoenix, at its discretion will accept, refuse, change, cancel or add any client/organization and/or contract if Divi Phoenix considers this necessary.
